Terms

Scope

These Terms and Conditions apply to contracts with artography.pro, Michel Mrose, for photography, film and video, creative direction, post-production, drone, FPV and related services. Services are mainly provided to businesses, although assignments for private clients are also accepted.

An individual proposal, order confirmation or written agreement takes precedence over these Terms. Terms supplied by the client apply only where artography.pro has accepted them in writing.

Proposal and contract

Proposals remain valid for the period stated in them. A contract is formed when the proposal is accepted in writing, an order is confirmed or performance begins by mutual agreement. Email satisfies the written-form requirement under these Terms.

Scope, dates, deliverables, formats, usage rights and fees are defined in the individual proposal. Informal preliminary discussions and estimates do not create an obligation to perform.

Client cooperation

The client provides in good time all information, products, vehicles, access, contacts, permissions and approvals needed for the production. The client informs artography.pro of particular risks, safety rules, brand requirements and binding deadlines.

Delay or additional work caused by late, incomplete or incorrect cooperation may be charged separately and extends agreed deadlines as reasonably required.

Fees and expenses

Prices stated in the proposal apply in Swiss francs. Expenses, travel, permits, rentals, models, assistants, music, stock and other third-party costs are charged in addition only where agreed or subsequently required and approved.

VAT is handled as stated in the proposal or invoice. If no VAT is shown, no VAT is charged in addition. Additional requests, extra images, further corrections, express work or broader usage are proposed separately or charged according to time spent.

Payment

Invoices are payable in full within ten calendar days. artography.pro may require a reasonable advance payment for larger productions where stated in the proposal.

Once the payment period expires, the client is in default without further notice. artography.pro may withhold further services and the grant or exercise of usage rights until full payment. Statutory default consequences and demonstrable collection costs remain reserved.

Changes and additional work

Changes to the agreed scope are coordinated before they are carried out. Where possible, artography.pro will explain the effect on price and schedule. Correction rounds are included only to the extent stated in the proposal.

Changes of taste following approval of a visual direction, renewed editing of approved results, or subsequent changes to format or quantity are additional work.

Dates, weather and force majeure

Production dates become binding once confirmed in writing. Delivery dates require timely cooperation and approval by the client. Where weather is unsuitable, a weather-dependent production may be rescheduled once without a cancellation fee. Third-party and travel costs already incurred remain payable.

If performance is prevented by illness, accident, force majeure, official restrictions, safety risks, technical failure despite reasonable precautions, or another event outside reasonable control, the parties will arrange a replacement date. Further claims exist only where required by mandatory law.

Cancellation by the client

Where the client cancels all or part of a booking, the following compensation applies to the agreed production fee:

Up to 14 calendar days before the date: internal and external costs already incurred.
13 to 7 calendar days before the date: 30 per cent.
6 to 2 calendar days before the date: 60 per cent.
Less than 48 hours before the date or failure to attend: 100 per cent.

Demonstrable expenses saved will be credited. Firmly booked third-party services, travel and specialist costs are charged in addition at the amount actually incurred. The client may demonstrate that a lower loss was suffered.

Selection, delivery and acceptance

artography.pro makes the photographic or film selection unless client selection has been agreed. The agreed final files and formats are delivered. Unedited raw files, open project files and unselected material are not included unless expressly agreed.

The client reviews the delivery promptly and should report identifiable technical defects within ten calendar days. artography.pro will first be given a reasonable opportunity to correct the defect. Mandatory statutory rights of private clients remain unaffected.

Archiving

Following delivery, the client is responsible for its own backup. Unless otherwise agreed, artography.pro retains working and project files for up to twelve months after delivery. Permanent archiving or recoverability is not owed.

Copyright and usage rights

Copyright and moral rights remain with Michel Mrose or the expressly identified rights holder. Following full payment, the client receives the usage rights described in the proposal. Scope, media, territory, duration and exclusivity are governed exclusively by the agreement.

Unless otherwise agreed, usage rights may not be assigned, sublicensed, resold or used for image libraries. Use for training generative artificial intelligence or for datasets is not permitted. Technically necessary size and format adjustments are allowed; substantive editing or distortion requires consent.

Unauthorised use may be licensed retrospectively at the customary market fee. Further claims remain reserved. Additional information for work published on this website is available under Image rights and licensing.

Reference use

artography.pro publishes client projects, brands, names or recognisable people only with the prior approval of the client or relevant rights holder. Approval may be limited to particular images, channels or periods.

Third-party rights

The client ensures that brands, designs, products, text, music, locations and other material supplied by the client may be used. The client also arranges required consent from employees, models, owners and other participants where this falls within the client’s area of responsibility.

artography.pro will point out identifiable legal or practical risks but does not, unless specifically agreed, conduct a comprehensive rights clearance for material provided by the client.

Drone and FPV

Drone and FPV work is subject to weather, visibility, no-fly zones, permissions, property rights and safe operation. A particular route or shot cannot be guaranteed where legal or safety considerations prevent it.

Warranty and liability

artography.pro performs its services with the care customary in the industry. To the extent permitted by law, liability for indirect or consequential loss, loss of profit, loss of use and data loss is excluded. Liability for slight negligence is limited to the value of the affected assignment.

These limitations do not apply to intent, gross negligence, injury to life or health, or other cases of mandatory statutory liability. artography.pro is liable for independent third parties only to the extent required by law.

Private clients

For contracts with private clients, mandatory consumer protection rules and mandatory venues take precedence. Any provision of these Terms that cannot legally apply to a private client will not be applied to that client. The remaining provisions continue to apply.

Final provisions

Swiss law applies, excluding conflict-of-law referrals. For business clients, the ordinary courts at the registered place of business of artography.pro have jurisdiction. Mandatory venues, in particular for private clients, remain reserved.

If a provision is wholly or partly invalid, the validity of the remaining provisions is unaffected and the applicable statutory rule takes its place. The version of these Terms incorporated when the contract was formed applies.
